A Warsaw man was arrested on child pornography charges after allegedly downloading a sexually explicit image on his phone.
Julian Love Garcia, 25, of 825 E. Smith St., apartment A, Warsaw, is charged with possession of child pornography, a Level 5 felony; and child pornography, a Level 6 felony.
He was booked into the Kosciusko County Jail at 10:52 p.m. Sept. 3 on a $10,250 preliminary bond.
According to the probable cause affidavit, on Sept 3 a Warsaw Police Department officer responded to a complaint that photos were downloaded to a phone by an employee of a store.
The officer spoke with a woman who said she was in the store to have one phone transferred from one device to another. When the employee, later identified as Garcia, was finished working with her phone, digital photographs were missing from her device.
The officer spoke with Garcia who said he did not delete or transfer any digital photos from the woman’s cell while working with the family on cell phones. Garcia consented to his iPhone being searched.
Another officer completed a forensic download of Garcia’s cell phone and located one sexually provocative digital photographic/video image depicting sexual conduct by a child who appeared to be less than 12. Garcia’s phone also contained one image depicting sexual conduct with a child who appeared to be less than 12. The image was stored in the hidden folder of the phone, which was password protected, according to the affidavit.
