James King, 48, of 1518 Dot St., Warsaw, was arrested for rape and sexual battery Tuesday, after he lured two sisters with mental disabilities into his home Saturday.
At 3:27 a.m. Saturday, Warsaw Police Department received a report for two missing 32-year-old females. While police were dispatched to search for them, their mother found them at King’s apartment.
According to the probable cause affidavit provided by the Kosciusko County Prosecutor’s Office, the two women had gone to King’s residence without their mother’s consent while she was sleeping. One victim told police that King had given them both alcohol.
The two were given breathalyzer tests and had blood alcohol contents of .125 and .129 respectively. Their mother told police that due to their mental disabilities, the two do not drink alcohol.
One sister told police that King had carried her to a back room in the apartment, laid her on the floor and tried to pull her pants down multiple times, but she would not allow it.
The second sister advised that she also was carried to the back room by King. When her sister fell asleep, King tried to perform intercourse, which hurt her. He then started touching her breasts under her shirt and kissed her lips once.
King then used his cell phone to take pictures of the woman’s genital regions. He then carried her to the living room and put his hand into her underwear.
The woman was transported to Fort Wayne Sexual Assault Treatment Center and treated by a sexual assault nurse examiner. The nurse noted an abrasion to the woman’s genitals, consistent with her account of King’s actions.
King gave police access to his cell phone, which contained five photographs of the woman nude. The photos were taken between 2:16 and 2:18 a.m. Saturday.
King was charged with rape, a level three felony, and sexual battery, a level six felony. He was booked into Kosciusko County Jail on a $101,000 bond.
