PLYMOUTH – A Marshall County murderer must be re-sentenced as ordered by the Indiana Court of Appeals.
Fabian Rubio pleaded guilty to the brutal December 2014 murder of Desi Jones, a 15-year-old Bremen High School student.
Rubio was sentenced to a maximum term of 65 years, but was serving time for another crime when the murder sentence was handed down.
The mistake came in calculating jail time credit he was owed.
As a result of the ruling, it appears that Rubio’s 65 year sentence stands to be reduced by about 20 months.
