A man who refused to leave his ex-girlfriend alone after allegedly battering her is facing a slew of charges including stalking and calling in bomb threats to a local supermarket.
Danny Bruce Kirby Jr., 49, of 534 N. Parker St., Warsaw, was booked in the Kosciusko County Jail at 12:43 a.m. Nov. 30 and faces charges in three open cases for stalking, a Level 5 felony; two charges for false informing, Level 6 felonies; intimidation, a Level 6 felony; domestic battery causing moderate bodily injury, a Level 6 felony; and harassment, a Class B misdemeanor.
According to the probable cause affidavits filed in the cases, on Nov. 15 at 1:43 a.m. Warsaw police responded to a home in reference to a domestic battery.
Upon arrival, officers spoke with a woman who said Kirby, her live-in boyfriend, had punched and kicked her in the face and also kicked her when she was on the floor. Police observed injury to the woman, according to the affidavit, including a cut on her face that was bleeding.
At the time, police were unable to locate Kirby.
On Nov. 20, according to the harassment case affidavit, police took a report from the woman and filed harassment charges against Kirby after the woman showed police incessant text messages Kirby had sent her, despite her repeated requests for him to stop. Kirby was begging for a second chance in the relationship, said he was camping out in a yard area nearby the woman’s residence and said multiple times he could see her, according to the messages.
Then, on Nov. 27 Warsaw police responded to a bomb threat that was phoned in to a Warsaw store. Police obtained the phone number used to phone in the threat.
On Nov. 28, another bomb threat was phoned in to the same store by the same phone number, according to the affidavit. During this call, Kirby allegedly told store employees he was going to put a bullet in someone’s head.
Police then spoke with the woman who played several voicemails Kirby had left for her including that there were bombs in her vehicle.
On Nov. 29, Kirby made three calls to the Kosciusko County Central Dispatch line, including one to the 911 line, threatening bombs and stating he was going to kill someone.
Dispatchers were able to trace the call’s ping from a cell tower, showing it was coming from a local hotel.
When police went to the hotel, they were told what room Kirby was staying in, but Kirby wouldn’t answer the door, according to the affidavit. Police obtained a warrant to enter the room and took Kirby into custody, according to court papers. On Kirby’s person, police found a cell phone that matched the phone number for all of the bomb threats.
According to court records, Kirby was served with an order for protection to keep him from harassing the woman or contacting her, and was served that while he was incarcerated at KCJ on Dec. 1.
Kirby was previously convicted in June 2017 in Fulton County for invasion of privacy and in April 1995 in Jay County for arson, according to court records.
His bond was set at $5,250.
