The trial for a New Paris woman accused in the death of a 19 month-old will, for the time being, remain in Elkhart County. Jackie Rolston’s first trial was declared a mistrial last month after a juror shared information about Rolston’s past charges of neglect of a dependent with other jurors.
In a hearing Thursday Rolston’s attorney requested a relocation to avoid an unfair trial, according to ABC57. The lawyer cited media coverage, community opinion of the case, the mistrial, and the Kirk’s Law child abuser registry as reasons why the trial should move. If an impartial jury can’t be seated, a move will be considered. Rolston is charged with battery in the death of 19-month-old Kirk Coleman. The trial is set for November 28th.
